⚠️ Important Louisiana Law Notice

Under Louisiana law, there is no automatic right to cancel or return a used vehicle purchase. Unlike some states, Louisiana does NOT mandate a three-day "cooling off" period for used car sales. Once you sign a purchase contract, you are legally bound by its terms. Any return provisions described below are offered solely at the discretion of Cruz Auto Sales and are not required by Louisiana state law. Please review all documents carefully and ensure you are fully satisfied before completing your purchase.

1. Louisiana Law Background

The State of Louisiana does not require licensed used motor vehicle dealers to accept vehicle returns or provide a cancellation period. Louisiana Revised Statutes governing motor vehicle sales (RS 32:781 et seq.) and the Louisiana Used Motor Vehicle Commission (LUMVC) regulations focus on licensing, dealer conduct, disclosure requirements, and consumer protections — but do not mandate a return window.

However, Louisiana law does provide certain protections through:

  • Implied Warranty of Merchantability: The vehicle must be fit for basic transportation purposes
  • Louisiana Lemon Law (RS 51:1941): Protection against vehicles with substantial defects that cannot be repaired within a reasonable number of attempts
  • FTC Used Car Rule: Buyer's Guide disclosure of warranty status and major systems
  • Material Misrepresentation: Legal remedies if a dealer misrepresents material facts about a vehicle

2. Our Voluntary Return Policy

While not legally required by Louisiana law, Cruz Auto Sales offers the following voluntary return consideration on a case-by-case basis, subject to the conditions listed below:

Time Window

Return considerations must be requested within 3 business days of the sale date. This is a voluntary program — not a legal right.

Mileage Limit

Vehicle must not have been driven more than 150 miles since purchase.

Vehicle Condition

Vehicle must be returned in the same condition as sold — no new damage, modifications, or alterations.

Documentation

All original documents (title, Buyer's Guide, contract, keys, accessories) must be returned.

3. Conditions & Exclusions

Return considerations will NOT be granted in the following circumstances:

  • Vehicles that have been in an accident after purchase
  • Vehicles that have been altered, modified, or customized after purchase
  • Vehicles with new mechanical issues caused by the buyer after purchase
  • Vehicles purchased at clearance/special sale prices (unless a material defect was not disclosed)
  • Situations where buyer's remorse is the sole reason (no defect or misrepresentation)
  • Vehicles where the buyer has failed to make any required payments under financing agreements
  • After 3 business days from the sale date
  • After vehicle has been driven more than 150 miles post-purchase

4. Defect-Based Returns & Louisiana Lemon Law

If you discover a material defect that was not disclosed at the time of sale, you may have legal rights beyond our voluntary policy. Louisiana law provides remedies for undisclosed material defects, misrepresentation, and fraud in vehicle sales.

Louisiana Lemon Law Protection (RS 51:1941)

Louisiana's lemon law may apply if:

  • The vehicle has been out of service for 90+ cumulative days
  • Four or more repair attempts have been made for the same substantial defect
  • The claim is filed within 3 years of purchase OR 1 year after warranty expiration (whichever is later)

Remedies may include: vehicle replacement, full refund, or cash compensation

5. How to Request a Return Consideration

  1. Contact Us Immediately: Call us at 504-498-4375 within 3 business days of your purchase
  2. Describe the Issue: Explain why you are requesting a return consideration. All requests will be reviewed by management.
  3. Schedule Vehicle Inspection: We will inspect the vehicle to assess its current condition
  4. Management Review: Our management team will review your request within 2 business days
  5. Written Decision: You will receive a written response to your request

6. Refund Process (If Approved)

If a return is approved, refunds will be processed as follows:

  • Cash purchases: Refund by check within 5-7 business days
  • Credit/debit card purchases: Refund to original card within 5-10 business days
  • Financed purchases: Finance company will be notified; loan payoff will be arranged per lender terms
  • Louisiana state taxes, title fees, and registration fees may not be fully recoverable as they are paid to the State of Louisiana
  • A restocking fee may apply as disclosed in your sales contract
