Important: Please read these Terms and Conditions carefully before purchasing a vehicle from Cruz Auto Sales. By completing a purchase, you agree to be bound by these terms. These terms comply with Louisiana Revised Statutes Title 32, applicable LUMVC regulations, and the Federal Trade Commission Used Car Rule.
1. Dealer Information & Licensing
Cruz Auto Sales is a licensed used motor vehicle dealer under the Louisiana Used Motor Vehicle Commission (LUMVC), License #: UD.00247411. We maintain the required $50,000 surety bond and minimum $55,000 garage liability insurance as required by Louisiana law (RS 32:781 et seq.).

2. Vehicle Pricing & Fees
All advertised prices are subject to the following additions:
- Louisiana State Sales Tax: Currently 5% as of January 2025 (Act 11, HB 10), plus applicable local/parish taxes
- Title Transfer Fee: $68 (Louisiana Office of Motor Vehicles)
- Registration Fee: $40 (may vary by vehicle type)
- Documentation Fee: As disclosed at time of sale (not to exceed Louisiana regulatory limits)
- Public License Tag Agent Fee: Up to $23 as permitted under Louisiana law
- Any applicable inspection fees
Prices listed on our website and lot are subject to change without notice. All advertised prices are for cash purchase only. Financing may result in different purchase terms. Cruz Auto Sales reserves the right to correct typographical errors in pricing.
3. FTC Used Car Rule — Buyer's Guide
As required by the Federal Trade Commission Used Car Rule (16 CFR Part 455), Cruz Auto Sales will provide a Buyer's Guide for every used vehicle offered for sale. The Buyer's Guide will disclose:
- Whether the vehicle is sold "As Is" or with a warranty
- What percentage of repair costs the dealer will pay under any warranty
- A warning that spoken promises may be difficult to enforce
- An encouragement to get all promises in writing
- The 14 major mechanical and electrical systems of the vehicle
- Contact information for dealer complaints
The Buyer's Guide becomes part of your sales contract and takes precedence over any conflicting contract provisions.
4. "As Is" Sales & Warranties
Louisiana-Specific Disclosure: Louisiana law (RS 9:3304) requires specific "As Is" disclosures different from many other states. Where a vehicle is sold "As Is," such disclosure will be clearly documented on the Buyer's Guide and sales contract.
Implied Warranties: Under Louisiana law, used vehicles sold by licensed dealers carry an implied warranty of merchantability — meaning the vehicle should be fit for its basic purpose of transportation. This implied warranty exists unless explicitly disclaimed in writing.
Written Warranties: Where we offer a written warranty, the specific terms, covered systems, coverage percentages, duration, and any deductibles will be clearly stated in writing in the Buyer's Guide and/or separate warranty document.
5. Vehicle History & Condition Disclosure
Cruz Auto Sales is committed to full disclosure. We will provide:
- Vehicle Identification Number (VIN) for independent verification
- Odometer disclosure in compliance with federal odometer laws (49 USC §32705)
- Known material defects and prior damage disclosures
- Vehicle history report availability upon request
- Prior use information (rental, lease, fleet, etc.) when known
Pre-Purchase Inspections: We strongly encourage and welcome independent pre-purchase inspections by a mechanic of your choosing. This is consistent with FTC Used Car Rule recommendations and Louisiana consumer protection guidance.
6. Title Transfer
Cruz Auto Sales will transfer a clear title to the buyer for every vehicle sold, in compliance with Louisiana RS 32:701 et seq. Title transfer will be processed through the Louisiana Office of Motor Vehicles. Any existing liens will be fully satisfied prior to or at the time of sale. Louisiana law requires lienholders to file termination statements within one month of lien satisfaction.
7. Financing
Where financing is offered or arranged through Cruz Auto Sales:
- All financing terms will be disclosed in writing including: exact purchase price, amount financed, total finance charge, Annual Percentage Rate (APR), number and amount of payments, and total sales price
- Maximum credit check fee: $425 as permitted under Louisiana law
- All consumer rights are protected and cannot be waived except as specifically permitted by Louisiana law
- Spot delivery / conditional sales agreements will comply with Louisiana RS 32:784 et seq.
8. No Right of Rescission / Cooling-Off Period
Important Louisiana Law Notice: Unlike some states, Louisiana does NOT provide a statutory three-day right to cancel a used car purchase. Once a sale contract is signed, the purchaser is bound by its terms. Any return policy offered by Cruz Auto Sales is entirely discretionary and is described in our separate Return Policy. Before signing any contract, please ensure you are fully satisfied with your purchase decision.
9. Louisiana Lemon Law
Louisiana's lemon law (RS 51:1941 et seq.) provides certain protections for used vehicle purchasers. You may have rights under this law if your vehicle has been out of service for 90 or more cumulative days, or has undergone 4 or more repair attempts for the same defect. Claims must be filed within 3 years from the date of purchase or within 1 year of the expiration of the warranty period, whichever is later.

These Terms and Conditions are governed by the laws of the State of Louisiana. Any legal action arising from vehicle sales transactions shall be brought in courts of competent jurisdiction in Louisiana.
